End User License Agreement (EULA)<\/p>

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SOFTWARE. BY USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE.<\/p>

This End User License Agreement (“EULA”) is a legal agreement between the individual or legal entity user (the “USER”) and Infinity Zeros, headquartered in Rio de Janeiro, RJ, ZIP Code 20921393, CNPJ 42.362.364.0001\/61 (the “LICENSOR”), for the use of the computer program “ModFy” (the “SOFTWARE”), available on the official website infinityzeros.com, which includes systems, websites, and any services provided by the LICENSOR, for the duration of its use.<\/p>

The use of any service provided by the LICENSOR is subject to the acceptance of this EULA in its entirety.<\/p>

1. Definitions
1.1. SOFTWARE: Computer program in its various versions, functionalities, and components, exclusively owned by the LICENSOR, protected and regulated by Brazilian Law 9.609\/98.
1.2. ACCESS DATA: Set of information necessary for the use of the SOFTWARE.
1.3. MODDERS: Individuals or entities that create and provide content on the ModFy.
1.4. MODS: Content created and provided by MODDERS on the ModFy, including but not limited to game modifications, textures, scripts, information, and other related materials.<\/p>

2. Object
2.1. This instrument grants the right to use the SOFTWARE for a determined period at the time of licensing, covering the computer program and may include any printed materials and any online or electronic documentation. By using the SOFTWARE, even partially or as a test, the licensee will be bound by the terms of this EULA, agreeing to them. In case of disagreement with the terms presented here, the use of the SOFTWARE must be immediately discontinued.<\/p>

3. Intellectual Property
3.1. The SOFTWARE, illustrations, and other components included in this product version are the property of the LICENSOR and are protected by copyright laws and international copyright treaties. You may not remove or hide any ownership notices, labels, or marks from this SOFTWARE.
3.2. The USER does not acquire, through this instrument, any intellectual property rights or other exclusive rights, including patents, designs, trademarks, copyrights, or rights to confidential information or business secrets, about or related to the SOFTWARE or any part of it. The USER also acquires no rights about or related to the SOFTWARE or any of its components. Any rights not expressly granted under this instrument are reserved to the LICENSOR. Also, all content published within the SOFTWARE, including but not limited to, texts, graphics, images, logos, icons, photographs, editorial content, notifications, software, MODS, and any other material, will be the exclusive property of the LICENSOR or duly licensed.<\/p>

4. SOFTWARE Use License
4.1. This License Agreement grants the USER a revocable, non-exclusive, and non-transferable license to use the SOFTWARE. The USER may not use or allow the use of the SOFTWARE for any purpose other than internal use. This license does not imply the ability to access other software beyond those originally located in the SOFTWARE. Under no circumstances will the USER have access to the source code of the SOFTWARE, as it is intellectual property.
4.2. The distribution of this SOFTWARE is done solely through download from the official website: infinityzeros.com or previously authorized sites. You may download this SOFTWARE as many times as needed indefinitely.
4.3. The LICENSOR reserves the right to modify the technical specifications, license, terms, and licensing conditions as deemed appropriate at any time.
4.4. The license is valid until terminated by the LICENSOR or the USER. Your rights under this license will be automatically and without prior notice terminated by the LICENSOR if you fail to comply with any term of this license. Upon termination of the License, you must cease all use of the Licensed Application and destroy all copies, in whole or in part, of the Licensed Application.
4.5. If any of the terms of this agreement are or become invalid, the validity of the remaining provisions will not be affected. The invalid terms will be replaced by valid terms, formulated to achieve the main objective.
4.6 From time to time, the LICENSOR may provide updates, upgrades, patches, bug fixes, and other modifications to improve the Software and related services (“Patches”). The USER acknowledges that it may be necessary to install Patches to continue accessing and using the SOFTWARE. You agree and consent that Patches will be automatically installed without receiving any additional notice or providing any additional consent.<\/p>

5. Restrictions
5.1. It is not allowed to modify, alter, decompile, reverse engineer, disassemble, or otherwise reduce this SOFTWARE to a perceptible form.
5.2. It is not allowed to sell, rent, lease, sublicense, transfer, or resell for profit this SOFTWARE or any part of it.
5.3. It is not allowed to modify this SOFTWARE or create derivative works based on the SOFTWARE.
5.4. It is not allowed to share your access data with others, as they are unique and non-transferable.
5.5. You may not use the provided content on more than one computer simultaneously unless you have previously acquired additional licenses.
5.6. In case of any violation, even if automatically detected without human interference, of these terms, you will lose access to your account and any other account related to the same user indefinitely.
5.7. Depending on the severity of the violation and applicable laws, the LICENSOR may take legal action against the user. This may lead to lawsuits, legal proceedings, and potential financial sanctions or damages awarded to the developer for the infringement. In some cases, the software developer may request an injunction to prevent the user from continuing to use or distribute the SOFTWARE, violating the end-user license agreement. An injunction is a court order that restricts certain activities and can be legally enforced. In rare cases, the LICENSOR may disclose the violation, generating negative publicity and possible damage to the user’s personal or professional reputation.<\/p>

6. User Obligations
6.1. The SOFTWARE requires a Windows 8 64-bit or higher Operating System, genuine and fully functional with all its original functions. The Licensor recommends using the latest firmware version.
6.2. You acknowledge that it is your responsibility to confirm and determine whether the device on which you intend to use the SOFTWARE meets the technical specifications mentioned above.
6.3. The responsibility for keeping the ACCESS DATA safe lies with the USER, thus exempting any liability from the LICENSOR.
6.4. Do not publish, send, or transmit any file containing viruses, trojans, or any other program that may contaminate, destroy, or interfere with the proper functioning of the SOFTWARE.
6.5. Do not use the SOFTWARE in any way that may involve unlawful acts, infringement, violation of rights, or harm to the LICENSOR or third parties, including but not limited to using it for computer intrusion with the aim of obtaining, altering, or destroying data or information without the express authorization of the owner of such data or the device or server on which they are stored.
6.6. Maintain, at your own expense, broadband Internet access to use the SOFTWARE.
6.7. Keep the SOFTWARE and related components always updated to the latest version from the manufacturer.
6.8. Maintain a trained team for SOFTWARE operation and communication with the LICENSOR and provide, whenever any problems with the SOFTWARE occur, all documentation and information that report the circumstances in which the problems occurred, aiming to facilitate and expedite work, as well as any details requested by the LICENSOR.
6.9. Clearly report the occurrence of any technical problems and, if necessary, provide reports, access to the SOFTWARE, and information necessary for the LICENSOR to provide technical support.
6.10. Be responsible for any information or content entered in the SOFTWARE, for the registration, permissions, passwords, and mode of use of your clients. The LICENSOR will never be responsible for the content (information, passwords, copies of information, etc.) about the SOFTWARE, and these pieces of information are therefore never reviewed at any time. The responsibility for the information in the SOFTWARE is always on the USER.
6.11. Duty to install and periodically update security systems on their equipment that identify and combat the operation of viruses or any other operational defect.<\/p>

7. MODS and Responsibility
7.1. The responsibility for all content related to MODDERS and MODS lies exclusively with the MODDERS, and any inquiries about this content should be made directly to the MODDER responsible for the content.
7.2. The LICENSOR assumes no responsibility for the accuracy, completeness, or legality of MODS or information provided by MODDERS.
7.3. The USER acknowledges that data and content related to MODDERS, MODS, and any associated material are the sole responsibility of the MODDERS.
7.4. If the USER loses access to their account on the SOFTWARE, all access to MODS and content provided by MODDERS will be lost since these are accessible only through the SOFTWARE.<\/p>

8. Disclaimer
8.1. The SOFTWARE is distributed “AS IS” and “AS AVAILABLE” with all faults and without warranties of any kind, express or implied. You use this SOFTWARE at your own risk. The authors shall not be held liable for data loss, damages, loss of profits, or any other type of loss when installing this SOFTWARE.
8.2. The LICENSOR is not obligated, either expressly or implicitly, to provide any maintenance, technical support, or other support for the SOFTWARE.
8.3. The LICENSOR attempts to keep the SOFTWARE updated to be in compliance with modified\/new versions of firmware and new hardware. You have no rights to claim such an update.<\/p>

9. Jurisdiction and Applicable Law
9.1. This EULA shall be governed and construed in accordance with the laws of the Federative Republic of Brazil.
9.2. The courts of the city of Rio de Janeiro – RJ are chosen to settle any doubts in the application of this EULA, with the express waiver of any others that may exist.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

LEIA ESTE CONTRATO COM ATEN\u00c7\u00c3O ANTES DE USAR O SOFTWARE. AO USAR O SOFTWARE, VOC\u00ca CONCORDA EM CUMPRIR OS TERMOS DESTE CONTRATO. SE VOC\u00ca N\u00c3O CONCORDAR COM OS TERMOS DESTE CONTRATO, N\u00c3O USE O SOFTWARE.<\/p>

Este Contrato de Licen\u00e7a de Usu\u00e1rio Final (“EULA”) \u00e9 um acordo legal entre o usu\u00e1rio pessoa f\u00edsica ou jur\u00eddica (o “USU\u00c1RIO”) e a Infinity Zeros, com sede em Rio de Janeiro, RJ, CEP 20921393, CNPJ 42.362.364.0001\/61 (a “LICENCIANTE”), para o uso do programa de computador “ModFy” (o “SOFTWARE”), dispon\u00edvel no site oficial infinityzeros.com, que inclui sistemas, sites e qualquer servi\u00e7o prestado pela LICENCIANTE, pelo prazo em que utiliz\u00e1-lo.<\/p>

A utiliza\u00e7\u00e3o de todo e qualquer servi\u00e7o prestado pela LICENCIANTE, est\u00e1 condicionada ao aceite deste EULA na sua totalidade.<\/p>

1. Defini\u00e7\u00f5es
1.1. SOFTWARE: Programa de computador em suas diferentes vers\u00f5es, funcionalidades e componentes, de propriedade exclusiva da LICENCIANTE, protegido e regulado pela Lei Brasileira 9.609\/98.
1.2. DADOS DE ACESSO: Conjunto de informa\u00e7\u00f5es necess\u00e1rias para fins de uso do SOFTWARE.
1.3. MODDERS: Indiv\u00edduos ou entidades que criam e disponibilizam conte\u00fado no ModFy.
1.4. MODS: Conte\u00fado criado e disponibilizado pelos MODDERS no ModFy, incluindo, mas n\u00e3o se limitando a, modifica\u00e7\u00f5es de jogos, texturas, scripts, informa\u00e7\u00f5es e outros materiais relacionados.<\/p>

2. Objeto
2.1. O presente instrumento tem como objeto o direito de uso por prazo determinado no ato do licenciamento do SOFTWARE, que abrange o programa de computador e pode incluir quaisquer materiais impressos, e qualquer documenta\u00e7\u00e3o online ou eletr\u00f4nica. Ao utilizar o SOFTWARE, mesmo que parcial ou a t\u00edtulo de teste, o licenciado estar\u00e1 vinculado aos termos deste EULA, concordando com os mesmos. Em caso de discord\u00e2ncia dos termos aqui apresentados, a utiliza\u00e7\u00e3o do SOFTWARE deve ser imediatamente interrompida.<\/p>

3. Propriedade Intelectual
3.1. O SOFTWARE, ilustra\u00e7\u00f5es e outros componentes inclu\u00eddos nesta vers\u00e3o do produto s\u00e3o de propriedade da LICENCIANTE e protegidos por leis de direitos autorais e tratados internacionais de direitos autorais. Voc\u00ea n\u00e3o pode remover ou ocultar quaisquer avisos de propriedade, r\u00f3tulos ou marcas deste SOFTWARE.
3.2. O USU\u00c1RIO n\u00e3o adquire, pelo presente instrumento, nenhum direito de propriedade intelectual ou outros direitos exclusivos, incluindo patentes, desenhos, marcas, direitos autorais ou direitos sobre informa\u00e7\u00f5es confidenciais ou segredos de neg\u00f3cio, sobre ou relacionados ao SOFTWARE ou nenhuma parte dele. O USU\u00c1RIO tamb\u00e9m n\u00e3o adquire nenhum direito sobre ou relacionado ao SOFTWARE ou qualquer componente dele. Quaisquer direitos n\u00e3o expressamente concedidos sob o presente instrumento s\u00e3o reservados \u00e0 LICENCIANTE. Tamb\u00e9m ser\u00e1 de propriedade exclusiva da LICENCIANTE ou est\u00e1 devidamente licenciado, todo o conte\u00fado publicado dentro do SOFTWARE, incluindo, mas n\u00e3o se limitando a, textos, gr\u00e1ficos, imagens, logos, \u00edcones, fotografias, conte\u00fado editorial, notifica\u00e7\u00f5es, softwares, MODS e qualquer outro material.<\/p>

4. Licen\u00e7a de Uso do SOFTWARE
4.1. Este termo de contrato de Licen\u00e7a concede ao USU\u00c1RIO uma licen\u00e7a revog\u00e1vel, n\u00e3o exclusiva e intransfer\u00edvel para usar o SOFTWARE. O USU\u00c1RIO n\u00e3o poder\u00e1 utilizar e nem permitir o uso do SOFTWARE para uma outra finalidade que n\u00e3o seja o uso interno. Esta licen\u00e7a n\u00e3o implica na capacidade de acessar outros softwares al\u00e9m daqueles originalmente localizados no SOFTWARE. Em nenhuma hip\u00f3tese o USU\u00c1RIO ter\u00e1 acesso ao c\u00f3digo fonte do SOFTWARE, por este se tratar de propriedade intelectual.
4.2. A distribui\u00e7\u00e3o deste SOFTWARE \u00e9 feita \u00fanica e exclusivamente por meio de download pelo site oficial: infinityzeros.com ou sites previamente autorizados. Voc\u00ea poder\u00e1 fazer o download quantas vezes precisar deste SOFTWARE por tempo indeterminado.
4.3. A LICENCIANTE reserva-se o direito de modificar as especifica\u00e7\u00f5es t\u00e9cnicas, licen\u00e7a, termos e condi\u00e7\u00f5es do licenciamento conforme considerar apropriado a qualquer momento.
4.4. A licen\u00e7a \u00e9 v\u00e1lida at\u00e9 ser rescindida pela LICENCIANTE ou pelo USU\u00c1RIO. Seus direitos sob esta licen\u00e7a ser\u00e3o rescindidos automaticamente e sem aviso pr\u00e9vio da LICENCIANTE se voc\u00ea n\u00e3o cumprir qualquer termo desta licen\u00e7a. Ap\u00f3s a rescis\u00e3o da Licen\u00e7a, Voc\u00ea dever\u00e1 interromper todo o uso do Aplicativo Licenciado e destruir todas as c\u00f3pias, totais ou parciais, do Aplicativo Licenciado.
4.5. Se algum dos termos deste acordo for ou se tornar inv\u00e1lido, a validade das restantes disposi\u00e7\u00f5es n\u00e3o ser\u00e1 afetada. Os termos inv\u00e1lidos ser\u00e3o substitu\u00eddos por termos v\u00e1lidos, formulados de forma a atingir o objetivo principal.
4.6 De tempos em tempos, a LICENCIANTE pode fornecer atualiza\u00e7\u00f5es, upgrades, patches, corre\u00e7\u00f5es de bugs e outras modifica\u00e7\u00f5es para melhorar o Software e servi\u00e7os relacionados (“Patches”). O USU\u00c1RIO reconhece que pode ser necess\u00e1rio instalar Patches para continuar a acessar e usar o SOFTWARE. Voc\u00ea concorda e consente que os Patches sejam instalados automaticamente sem receber qualquer aviso adicional ou fornecer qualquer consentimento adicional.<\/p>

5. Restri\u00e7\u00f5es
5.1. N\u00e3o \u00e9 permitido modificar, alterar, decompilar, aplicar engenharia reversa, desmontar ou de qualquer outra forma reduzir este SOFTWARE a uma forma percept\u00edvel.
5.2. N\u00e3o \u00e9 permitido vender, alugar, arrendar, sublicenciar, transferir, tampouco revender visando lucro este SOFTWARE ou qualquer parte dele.
5.3. N\u00e3o \u00e9 permitido modificar este SOFTWARE ou criar trabalhos derivados com base no SOFTWARE.
5.4. N\u00e3o \u00e9 permitido compartilhar seus dados de acesso com outras pessoas, pois estes s\u00e3o \u00fanicos e intransfer\u00edveis.
5.6. Voc\u00ea n\u00e3o poder\u00e1 utilizar o conte\u00fado fornecido em mais de um computador simultaneamente, a menos que tenha adquirido previamente licen\u00e7as adicionais.
5.5. Em caso de qualquer viola\u00e7\u00e3o, mesmo que seja detectada automaticamente sem interfer\u00eancia humana, destes termos, voc\u00ea perder\u00e1 o acesso \u00e0 sua conta e a qualquer outra conta que seja relacionada ao mesmo usu\u00e1rio, por tempo indeterminado.
5.6. Dependendo da gravidade da viola\u00e7\u00e3o e das leis aplic\u00e1veis, a LICENCIANTE poder\u00e1 tomar medidas legais contra o usu\u00e1rio. Isto pode levar a a\u00e7\u00f5es judiciais, processos judiciais e potenciais san\u00e7\u00f5es financeiras ou danos concedidos ao desenvolvedor pela infra\u00e7\u00e3o. Em alguns casos, o desenvolvedor do software pode solicitar uma liminar para impedir que o usu\u00e1rio continue a usar ou distribuir o SOFTWARE, violando o contrato de licen\u00e7a do usu\u00e1rio final. Uma liminar \u00e9 uma ordem judicial que restringe certas atividades e pode ser executada legalmente. Em raros casos, a LICENCIANTE pode divulgar a viola\u00e7\u00e3o, gerando publicidade negativa e poss\u00edveis danos \u00e0 reputa\u00e7\u00e3o pessoal ou profissional do usu\u00e1rio.<\/p>

6. Obriga\u00e7\u00f5es do Usu\u00e1rio
6.1. O SOFTWARE requer uma vers\u00e3o de Sistema Operacional Windows 8 64bits ou superior, original e com pleno funcionamento de todas suas fun\u00e7\u00f5es originais. O Licenciante recomenda usar a vers\u00e3o mais recente do firmware.
6.2. Voc\u00ea reconhece que \u00e9 sua responsabilidade confirmar e determinar se o dispositivo no qual Voc\u00ea pretende usar o SOFTWARE atende \u00e0s especifica\u00e7\u00f5es t\u00e9cnicas mencionadas acima.
6.3. A responsabilidade em manter a salvo os DADOS DE ACESSO \u00e9 do USU\u00c1RIO, eximindo assim qualquer responsabilidade da LICENCIANTE.
6.4. N\u00e3o publicar, enviar ou transmitir qualquer arquivo que contenha v\u00edrus, cavalos de troia ou qualquer outro programa que possa contaminar, destruir ou interferir no bom funcionamento do SOFTWARE.
6.5. N\u00e3o utilizar o SOFTWARE de qualquer forma que possa implicar em ato il\u00edcito, infra\u00e7\u00e3o, viola\u00e7\u00e3o de direitos ou danos \u00e0 LICENCIANTE ou terceiros, incluindo, mas n\u00e3o se limitando ao uso para invas\u00e3o de dispositivo inform\u00e1tico com o objetivo de obter, adulterar ou destruir dados ou informa\u00e7\u00f5es sem a autoriza\u00e7\u00e3o expressa do titular de tais dados ou do dispositivo ou servidor nos quais estes estejam armazenados.
6.6. Manter, a seus disp\u00eandios, acesso a Internet banda larga para utilizar o SOFTWARE.
6.7. Manter o SOFTWARE e componentes relacionados sempre atualizados na \u00faltima vers\u00e3o do fabricante.
6.8. Manter equipe capacitada para a opera\u00e7\u00e3o do SOFTWARE e para a comunica\u00e7\u00e3o com a LICENCIANTE e prover, sempre que ocorrerem quaisquerproblemas com o SOFTWARE, toda a documenta\u00e7\u00e3o e informa\u00e7\u00f5es que relatem as circunst\u00e2ncias em que os problemas ocorreram, objetivando facilitar e agilizar os trabalhos, assim como quaisquer detalhes solicitados pela LICENCIANTE.
6.9. Relatar de forma clara a ocorr\u00eancia qualquer problema de natureza t\u00e9cnica e, caso necess\u00e1rio, prover relat\u00f3rios, acesso ao SOFTWARE e informa\u00e7\u00f5es necess\u00e1rias para o LICENCIANTE oferecer suporte t\u00e9cnico.
6.10. Responder por toda e qualquer informa\u00e7\u00e3o ou conte\u00fados inseridos no SOFTWARE, pelo cadastramento, permiss\u00f5es, senhas e modo de uso de seus clientes. A LICENCIANTE em hip\u00f3tese alguma ser\u00e1 respons\u00e1vel pelo conte\u00fado (informa\u00e7\u00f5es, senhas, c\u00f3pias de informa\u00e7\u00f5es, etc) sobre o SOFTWARE, n\u00e3o sendo, portanto, estas informa\u00e7\u00f5es revisadas em momento algum. A responsabilidade pelas
informa\u00e7\u00f5es do SOFTWARE \u00e9 sempre do USU\u00c1RIO.
6.11. Dever de instala\u00e7\u00e3o e atualiza\u00e7\u00e3o peri\u00f3dica de sistemas de seguran\u00e7a em seus equipamentos que identifiquem e combatam a atua\u00e7\u00e3o de v\u00edrus ou qualquer outro v\u00edcio operacional.<\/p>

7. MODS e Responsabilidade
7.1. A responsabilidade por todo conte\u00fado relacionado a MODDERS e MODS \u00e9 exclusivamente dos MODDERS, e qualquer d\u00favida sobre esse conte\u00fado dever\u00e1 ser feita diretamente ao MODDER respons\u00e1vel pelo conte\u00fado.
7.2. A LICENCIANTE n\u00e3o assume qualquer responsabilidade pela precis\u00e3o, integridade ou legalidade dos MODS ou informa\u00e7\u00f5es fornecidas pelos MODDERS.
7.3. O USU\u00c1RIO reconhece que dados e conte\u00fados relacionados aos MODDERS, MODS e qualquer material associado s\u00e3o de responsabilidade exclusiva dos MODDERS.
7.4. Caso o USU\u00c1RIO perda o acesso a sua conta no SOFTWARE, todo acesso aos MODS e conte\u00fados disponibilizados pelos MODDERS ser\u00e1 perdido, uma vez que esses s\u00e3o acess\u00edveis apenas por meio do SOFTWARE.<\/p>

8. Isen\u00e7\u00e3o de Responsabilidade
8.1. O SOFTWARE \u00e9 distribu\u00eddo “NO ESTADO EM QUE SE ENCONTRA” e “CONFORME A DISPONIBILIDADE” com todas as falhas e sem garantias de qualquer tipo, expressa ou impl\u00edcita. Voc\u00ea usa este SOFTWARE por sua conta e risco.
